AFM APP PRIVACY POLICY

Asti Infotech Pvt. Ltd. respects the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our mobile application (the “Application”). Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

In order to use the Product, you must first acknowledge and agree to our Privacy Policy. You cannot use the Product without first accepting our Privacy Policy.

1. GENERAL

Asti Infotech provides the Asti Fleet Management Application (AFM), a tracking application for the employee transportation to ensure safety of their commute. AFM Mobile Application is a user-friendly platform which interacts with the user to capture, analyze and display data. Asti Infotech ("Asti", "we", "us") recognizes and understands the importance of the privacy of its users ("users", "You") and wants to respect their desire to store and access personal information in a private and secure manner. This Privacy Policy applies to our Application describes how AFM manages, stores and utilizes your Personal Data. In order to use AFM, we require you to consent to the collection and processing of your Personal Data before you start using the application. If you do not agree with the terms of this Privacy Policy, you may not use in any manner the application. AFM is committed to protecting the privacy of all of its users Personal Data and providing a secure, user-controlled environment. At the same time, you also share responsibility for maintaining privacy and security for example, by not allowing any third party to use your personal account on the AFM Mobile Application. AFM asks all users to be responsible for safeguarding any authentication information and to immediately notify us of any unauthorized use of your personal Account. Please read this Privacy Policy carefully so that you fully understand how we obtain and process your Personal Data. By accepting this Privacy Policy, you acknowledge and agree that you were adequately informed of the functioning and objectives of the Application.

2. DEFINITIONS

• "Account" means your account registered through the registration process on the AFM Mobile Application
• "Application" means the AFM Mobile Application made available to the users, located at Play Store or App Store
• "AFM Mobile Application" means the Mobile Application (i) which the user has to download on its mobile device and (ii) is intended to record, display, analyze, store and transmit your data
• "AFM Platform" means the platform on which the AFM Mobile Application and the AFM Dashboard are connected and collectively function
• "Insights" means the data collected via the application and rendered in an optimal way by the AFM Platform through the AFM Mobile Application and AFM Dashboard
• "Product" means the Mobile Application
• “Personal Data” is the information related to the application users
• "Third Parties" means any natural or legal person or entity other than AFM

3. COLLECTION OF YOUR INFORMATION

We may collect several types of personal information from the users of our Product, and store it on your mobile device and/or our server such as:

• Contact information (e.g. your name, postal address, e-mail address, and mobile or other telephone number)
• The data provided by you on your account such as your name and email address
• Information in helpdesk support inquiries
• Information collected by manual input by the Application

Geo-Location Information

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

• BACKGROUND_SERVICE Permission/ Always:
  We may collect location information at any time, even when you're not actively using the AFM app during the trip. Location information will be collected in background to provide real-time tracking to the customer & companies to ensure safety of the employees during the transit if the app is not in foreground. It also, help us in calculation the actual kms travelled to calculate the cost for the companies as the trip is free for the user. You will notify by a notification that app is running when we are fetching you location. Location updates are only used when you are running a duty
• FOREGROUND_SERVICE Permission/ While using the app:
  We may collect location information when the app is visible on your screen or when you have requested a ride and during your trip. Fetch the location and allow to start the ride.We need this information to perform many operational logics such as pickup location and drop location of employee.

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s [list all features that your app can connect to (e.g. Bluetooth)]. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data

Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

Push Notifications

We may request to send you push notifications regarding your Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Third-Party Data

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Application permission to access this information. Hereinafter collectively "Personal Data". We shall store all your Personal Data on our servers.

4. USE OF YOUR INFORMATION

AFM (i) collects, (ii) uses, (iii) maintains and (iv) may share your Personal Data provided by you or collected by us with its affiliates, parent companies or other related companies for all purposes necessary to ensure the proper functioning and operation of the User accounts and/or the proper functioning of the Products. These purposes may include (collectively the "Purpose"):

• Creating and managing your Account to use the Application;
• Providing information and allowing the Users access to the Product;
• Diagnosing technical problems and managing technical support and processing inquiries concerning the Products;
• Contacting the Users by phone, email, text message or push notifications (if they are enabled) to (i) verify your account (ii) for information and operational purposes such as account management, instructions, alerts, reminders, customer service, system maintenance and others
• The operation, evaluation and improvement of the Products (including the development of additional products and/or services, enhancing and improving the current Products, analysis of our Products, quality control activities and performing internal business functions such as accounting and auditing);
• Protecting against identity, prevent fraud and other unlawful activity, claims and other liabilities;
• Complying with and enforcing any applicable legal obligations with respect to our Terms of Use and Privacy Policy.
• We use geo-location information for various purposes, including for you to be able to view the drivers in your area that are close to your location, for you to set your pick up location, for the drivers to identify the pick-up location, and to allow you (if you choose through any features we may provide) to share this information with other people.

In addition, we may use your Protected Information or Usage Information that we collect about you: (1) to provide you with information or services or process transactions that you have requested or agreed to receive including to send you electronic newsletters, or to provide you with special offers or promotional materials on behalf of us or third parties; (2) to enable you to participate in a variety of the Services’ features such as online or mobile entry sweepstakes, contests or other promotions; (3) to contact you with regard to your use of the Services and, in our discretion, changes to the Services and/or the Services’ policies; (4) for internal business purposes; (5) for inclusion in our data analytics; and (6) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

By using the Application, you acknowledge and explicitly agree that we may disclose certain information to vendors and service providers who help us provide the Product. You furthermore understand and agree that the technical processing and transmission of the Products, including your Personal Data, may involve (i) transmissions over various networks; and (ii) modifications to conform and adapt to technical requirements of connecting networks, or devices.

5. DISCLOSURE OF YOUR INFORMATION

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

By Law or to Protect Rights

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

Marketing Communications

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.

Affiliates

We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

6. TRACKING TECHNOLOGIES

We may use cookies and other tracking technologies on the Application to help customize the Application and improve user experience. When you access the Application, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Application.

7. SECURITY OF INFORMATION

• AFM shall take appropriate administrative, technical and organizational measures against unauthorized or unlawful processing of any Personal Data or its accidental loss, destruction or damage, access, disclosure or use. Upon written request, AFM can provide you with a list of people of AFM that may have access to your Personal Data. These people have entered into confidentiality agreements prior to having been granted access to your Personal Data. In the event of and following discovery or notification of a breach of the security of the Personal Data, or access by an unauthorized person, AFM is required by law to notify the user if the breach is likely to affect your privacy. We also never:
• publicly disclose any personal or sensitive user data related to financial or payment activities or any government identification numbers.
• allow unauthorized publishing or disclosure of people's non-public contacts.

8. DATA RETENTION AND DELETION

In any event, your Personal Data shall not be kept longer than is necessary to achieve the ‘Purpose’, unless:

• The processing of your Personal Data is necessary to provide you any services.
• The retention is necessary to comply with any legal or regulatory obligation (e.g., for tax purposes), in which case we will keep your Personal Data for as long as required by that obligation
• The processing of your Personal Data is necessary in connection with any actual or potential dispute, in which case we will keep your Personal Data until the end of such dispute

9. UPDATES OR CHANGES TO OUR PRIVACY POLICY

Occasionally, we may change or update this Privacy Policy to allow us to use or share your previously collected Personal Data for other purposes. If AFM would use your Personal Data in a manner materially different from that stated at the time of the collection, we will provide you with a notice on our Website and in our AFM Mobile Application indicating that the Privacy Policy has been changed or updated and request you to agree with the updated or changed Privacy Policy.

10. YOUR RIGHTS

• If you are concerned about your Personal Data, you have the right to request access to the Personal Data which we hold or process about you. We will then provide you with information about the data that are being processed and on the source of those data.
• You have the right to request us free of charge to correct, erase or block any inaccuracies in your Personal Data if such Personal Data would be incomplete, inaccurate or processed unlawfully.
• You have the right to request us not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
• Without prejudice to the termination provisions of the Terms of Use, you may withdraw at any time your consent to the processing of your Personal Data by AFM by permanently removing the Application. Upon receipt of this notification, AFM shall promptly stop any processing of your Personal Data.
